Scope of application
These general conditions of sale are applicable to all sales of products concluded at a distance through the website www.dwellistore.com. These general conditions of distance selling must be carefully examined by the customer before completing the remote purchase procedure of the product. It is understood that the execution of the purchase order through this website implies total and absolute knowledge of these general conditions of sale and their full acceptance. The Customer, with the execution of the purchase order through the website www.dwellistore.com accepts unconditionally and undertakes to comply with these general conditions of sale, as well as the payment terms illustrated below, declaring to have read and accepted all the instructions provided to him. These general conditions of sale are to be considered applicable and in force as long as they are published on this website. Any modification of the general conditions of sale in question will be published on the website and the new general conditions of sale will be applicable only to orders placed from the day of their publication.
Identification of the seller and site owner
The information relating to products susceptible to distance selling through this website is provided in compliance with the laws in force and, in particular, with articles 52 and 53 of the Consumer Code (Legislative Decree 6 September 2005 No. 206).
Method of improvement of the contract
This information and the details contained on this website don't constitute an offer to sell, but an invitation to bargaining. There will be no contract between the Customer and the DWELLI company in relation to any products until the order has been explicitly accepted by DWELLI with one of the methods described below. If the offer isn't accepted and a debit has already been made to the customer's account, the relative amount will be returned to the same in its entirety. To place an order, the Customer must follow the purchase process online and complete the process. Subsequently, you will receive an email indicating that the order has been received. This won't entail the acceptance of the order, since the same constitutes an offer that the customer makes to DWELLI for the purchase of one or more products. All orders, subject to exceptions, will be subject to the approval of DWELLI by sending a confirmation email within 2 (two) working days following receipt of payment, indicating the receipt of payment, the availability of products and the order is being prepared. The contract between the company DWELLI and the customer will therefore be perfected only when we send the order confirmation (and will be subject to the contract only the products indicated in this confirmation email) or when the customer received the package for the order from the forwarder received (and only the products in the package will be the subject of the Contract). DWELLI won't have the obligation to provide other products, in addition to those indicated in the Order Confirmation to the Customer or present in the relative package received by the Forwarder, which may have been the subject of an order, until the Order Confirmation is sent to the Customer of the same in a Confirmation of the order separately. If the products are missing in the Order Confirmation or in the relative package received from the Forwarder, and this fact is the decision of DWELLI, the relative amount will be immediately reimbursed. DWELLI reserves the right to communicate within 2 working days following the sending to the customer of the email indicating the receipt of the order, the possible impossibility of processing the order, which will follow the eventual return of any amount paid , due to the exceeded exhaustion of goods or due to force majeure.
The website's prices don't include the VAT and include shipping costs for the Italian territory, unless otherwise indicated. Shipping costs for countries other than Italy will be duly indicated in the product sheet or during the purchase phase, before the conclusion of the order. In compliance with the provisions of art. 53 of the Consumer Code, the Customer receives, upon acceptance by DWELLI of their order by email, the written confirmation containing information about the products ordered, the amount paid and the details of the price of each product.
Conditions and methods of payment
Payment by the Customer can only be made by bank transfer, payment card or PayPal account. The Bank Transfer provides for the advance payment of the entire sum on the bank account in the name of DWELLI within 6 days from the approval of the order by DWELLI. If the transfer isn't received within 6 days, the order will be canceled. Upon receipt of the bank transfer, DWELLI will send the goods to the address indicated in the order.

Payments by Credit Card will take place through the secure gateway of PayPal. The Customer must enter the data of his credit card and confirm the transaction that will be immediate. DWELLI haven't access to the customer's credit card information in any way. All credit / debit card holders are subject to confirmation and authorization checks by the card issuing institution or by DWELLI itself. If the card issuer of the customer refuses the authorization to pay, DWELLI won't accept the order and won't be liable for any delay or non-delivery or obliged to explain the reasons for the refusal. DWELLI will not be responsible for any fees charged by the card issuing institution or by the bank responsible for processing the credit / debit card payment in accordance with your order. Upon payment, DWELLI will process the order, then eventually the same will be confirmed through the confirmation email, with which the goods will be sent to the address indicated in the order. Payments via PayPal require the possession of a PayPal account. The Customer must enter his email and password related to the PayPal account to access and confirm the immediate transaction through PayPal.
"If you buy with Scalapay you receive your order immediately and pay in 3 instalments. You acknowledge that the instalments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and that you authorise such assignment."
The delivery of the products is made to the shipping address indicated by the Customer in the order forwarded to the company DWELLI. In compliance with the provision contained in art. 54 of the Consumer Code, DWELLI will deliver the products within and no later than 30 days starting from the day on which DWELLI has confirmed the Customer's order. The company DWELLI delivers the products by express courier. At the time of delivery of the package to the courier, an email will be forwarded to the Customer, subject to exceptions. Upon receipt of the package, the Customer must definitely affix the words "Sign with reservation", so that we can rely on the insurance in case of damage to the contents of the package. In case of damage, communicate the incident to DWELLI within 72 working hours following the delivery date, through the email address firstname.lastname@example.org indicating in the subject "Order number N Damaged". The Customer must inform DWELLI of the non-delivery of the products, by sending an email to email@example.com indicating the item "Order number N No delivery". DWELLI undertakes to guarantee a new shipment of the lost products within 72 working hours following the notification by means of a specific email, without prejudice to the unavailability of the same or causes of force majeure. In this case, the immediate cancellation of the order and the simultaneous return of the amount paid will follow.
Limitation of liability
The DWELLI company will replace free or reimburse any sold product that has been damaged during shipment by its own forwarder, provided that:
- the Customer has communicated in writing to the address firstname.lastname@example.org (indicating in the object "Order number N Return for damage") the damage within 72 working hours after the delivery date;
- the Customer makes the product in question available to DWELLI, together with the original packaging.
If even one of the above conditions isn't met, DWELLI will not reimburse the amount paid, nor will it replace the product. DWELLI, in this case, will communicate by email the refusal of the return.
The execution of the services by DWELLI can be suspended in case of occurrence of a fortuitous event or force majeure that prevents or delays the execution. The strikes, earthquakes, floods, tsunamis, snowstorms and supply problems of DWELLI attributable to third-party suppliers and non-suppliers are considered as such, by way of non-exhaustive example. DWELLI will inform the Customer of the occurrence of the incident or force majeure within 7 days of the occurrence of the same. In the event that the suspension of the service should be extended for a period of more than 15 days, the Customer will have the opportunity to cancel the order placed and will be reimbursed the amounts already paid.
Right of withdrawal
As required by the Consumer Law, the customer can request the return of the goods within 14 days of receipt of the same. To do so, you must send a written communication by email to email@example.com, then arrange to send the goods, at your own expense, to DWELLI within 14 days from the communication. Upon receipt of the goods DWELLI will check the integrity of the same and refund within 14 days using the same payment method used by the customer at the time of purchase. DWELLI will reimburse to the Customer only a part of the total, in proportion to the damage. The right of withdrawal is not valid for customized products or in case of purchase by Professionals.
All the products sold by DWELLI are covered by the manufacturer's standard warranty and the 24-month warranty for conformity defects, pursuant to Legislative Decree 24/02. To use the warranty, the customer must keep the invoice (or the DDT) that will receive by e-mail or by mail. The manufacturer's standard warranty is provided in the manner described in the documentation included in the product packaging. If, following an intervention by an Authorized Service Center, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs, if supported by DWELLI. The 24-month warranty pursuant to Italian Law Decree 24/02 applies to products that present a lack of conformity, provided that the product itself is used correctly, respecting its intended use and as provided in the attached technical documentation. This guarantee is reserved to the private consumer (a natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference of VAT number). In case of lack of conformity, DWELLI will provide, without expenses for the Customer, to restore the conformity of the product by repair / replacement or reduction of the price, until the contract is terminated. Ff, following an intervention by an Authorized Service Center, the defect doesn't result in a lack of conformity pursuant to Decree 24/02, the Customer will be charged for any verification and restoration costs requested by the Authorized Assistance, as well as the transport costs if supported by DWELLI. The replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided by the manufacturer. Product replacement or repair times depend on the manufacturer's policies. In the event that, for any reason, it isn't able to provide its customer with a product under warranty (restored or replaced), DWELLI can proceed at its discretion to return the entire amount paid or to replace it with a product of features equal or superior. No damage can be requested to DWELLI for any delays in carrying out repairs or replacements. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc ...).
The personal data requested when placing the order are collected and processed in order to meet the express requests of the customer and won't under any circumstances and for any reason transferred to third parties. DWELLI guarantees its customers compliance with the law on the processing of personal data, governed by the privacy code pursuant to Legislative Decree 196 of 30.06.03. The data controller is Dwelli Srls.
Applicable law and competent court
These general conditions of sale are governed by Italian law. In case of disputes arising from the interpretation, validity and / or execution of these general conditions of sale, the customer has the right to protect their interests through a consumer association in the forms of art. 140 of the Consumer Code, or start an out-of-court settlement procedure for the resolution of consumer disputes pursuant to art. 141 of the Consumer Code. In any case, the Customer has the right to appeal to the ordinary ways of resolving disputes arising from the interpretation, validity and / or execution of these general conditions of sale and in this case the territorial jurisdiction will be that of the judge of the Court of Bari.
