GENERAL CONDITIONS OF SALE

The contract concluded between Dwelli Srls and the Customer shall be considered concluded with the acceptance of the order by the selling company. Such acceptance shall be deemed tacit, unless otherwise communicated in any manner to the Customer. By placing an order in the various modes provided, the Customer declares that he has read all the information provided to him during the purchase process, and fully accepts the general conditions and payment transcribed below.
- If the Customer is a consumer, once the online purchase procedure is completed, he/she will print or save an electronic copy and in any case keep these general conditions of sale, in accordance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling, and subsequent additions and amendments.
- The customer shall not be entitled to claim compensation or indemnity for damages, nor shall claims for contractual or extra-contractual liability be possible for direct or indirect damages caused by the non-acceptance, in whole or in part, of an order.
Mode of purchase
- The Customer may purchase the products in the electronic catalog of Dwelli Srls at the time of placing the order and viewable online at dwellistore.com as described in the relevant information sheets. It is understood that the image accompanying the description sheet of a product may not be perfectly representative of its characteristics but differ in features, color, size, accessory products present in the picture. All supporting information for purchase (Glossary, Buying Guide, etc.) are intended as mere generic information material, not referring to the real characteristics of an individual product.
- The correct receipt of the order is confirmed by Dwelli Srls by an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will contain the Date and Time of execution of the order and a “Customer Order Number”, to be used in any further communication with Dwelli Srls . The message will repeat all the data entered by the Customer who agrees to verify the correctness and promptly communicate any corrections, in the manner described in this document within 24h.

Methods of payment
- In case of non-execution of the order due to the unavailability, even temporary, of the goods, Dwelli Srls, within 3/5 working days from the day after the day on which the Customer has sent the order through the website dwellistore.it, will inform the Customer and will refund any sums already paid for the payment of the goods.
- In case of cancellation of the order, either by the Customer or by Dwelli Srls, the relevant amount will be credited back to the payment method used (PayPal, credit card through PayPal, Stripe or PayPlug). Time of re-crediting depends solely on PayPal, the banking system and payment gateways used, and Dwelli Srls is not responsible for any delays or damages caused by these entities.
- Advance Bank Transfer
The Advance Bank Transfer form of payment is possible on all catalog items. Any limitations are clearly highlighted within the shopping cart. In case of payment by Bank Transfer in Advance, what was ordered by the Customer will be kept committed until receipt of proof of transfer, to be sent to Dwelli Srls ([email protected]) no later than 3 working days from the date of acceptance of the order. The shipment of what has been ordered will take place only upon actual crediting of the amount due on the account of Dwelli Srls, which must take place within 7 working days from the date of acceptance of the order*
Advance Bank Transfer
Beyond these deadlines, the order will be deemed automatically cancelled.
The reason for the bank transfer must state:
the reference number of the order;
the date the order was placed;
first and last name of the order holder.*In case of cancellation of the order, either by the Customer or Dwelli Srls, the amount will be credited back to the Customer's bank account. The time of re-crediting depends on the banking system and Dwelli Srls is not responsible for any delays or damages caused by these entities.
In case of payments or credits, the client pays the commission costs. - For each order placed on the site dwellistore.it, Dwelli Srls issues a fiscal invoice of the material shipped, sending it by e-mail or by mail to the holder of the order, pursuant to art 14 D.P.R. 445/2000 and DL 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order. No change of document (data) will be possible, after the issuance of the same.
DELIVERY CONDITIONS

Delivery charges shown on each product sheet are the responsibility of the Customer. For the islands it is necessary to establish an ad hoc shipping cost. Payment of the goods by the Customer will be made using the method chosen when placing the order. Duties and storage hold are the responsibility of the customer.
Shipping times start upon receipt of the money by the customer. -
Dwelli Srls cannot be held responsible for any delays in order fulfillment or delivery of ordered products. This includes delays due to unusable road conditions, logistical problems, or other circumstances beyond our control (timing of production of goods). Under no circumstances will Dwelli Srls be liable for any damages resulting from such delays.
Delivery of products is at street level and does not include assembly or porterage services. The Customer is required to verify:

That the number of packages delivered corresponds to what is indicated in the transport document.

That the packaging is intact and undamaged, including sealing materials such as tape or metal strapping.

In case of failure to collect within 5 working days of the material in stock at the warehouses of the courier due to repeated inability to deliver to the address specified by the Customer when ordering, will be charged storage costs, and / or other taxes. ( or lack of availability of the customer)

Right of withdrawal
- Pursuant to Article 64 of Legislative Decree No. 206/2005, and subsequent additions and amendments, if the customer is a consumer, he/she has the right to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty, without prejudice to what is indicated in point 5.1 below.
- To exercise this right, the customer must retain the original packaging of the product sold and send Dwelli Srls a notice by form within fourteen (14) days from the date of receipt of the goods.
- The right of withdrawal is, however, subject to the following conditions:
- the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
- the purchased goods must be intact and returned in original packaging, complete in all its parts (including packaging and any documentation and ancillary equipment); to limit damage to the original package, we recommend, when possible, to put it in a second box; in accordance with the law, shipping costs related to the return of the goods are borne by the customer as duties, shipping and / or miscellaneous and any;
- the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer; in case of damage to the goods, Dwelli Srls will notify the Customer of the incident (within 5 working days of receipt of the goods in their warehouses), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the asset (if insured, which we recommend); in this case, the product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal, without any refund guaranteed;
-Dwelli Srls is not liable in any way for damage or theft/loss of returned goods. Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, Dwelli Srls will deduct from the refund due a percentage, up to a maximum of 20% of it, as a contribution to the costs of restoration. - Without prejudice to any repair costs for damages assessed to the original packaging, Dwelli Srls will refund the customer the full amount already paid, as soon as possible and in any event within fourteen (14) days from the date on which the communication of the exercise of the right of withdrawal by the consumer has arrived. The refund will be made through the procedure of transferring the amount charged to the Credit Card or by Bank Transfer. In any case, it will be the Customer's responsibility to promptly provide the necessary and useful data to obtain the refund.
- The right of withdrawal lapses completely in case of lack of integrity of the property (packaging and / or content) if Dwelli Srls finds:
The absence of the outer packaging and / or the original inner packaging.
-The lack of essential elements of the product (accessories, manuals, parts, etc.).
-Damage to the product due to causes other than transportation.
-Goods will be held for 30 days at our warehouse free of charge, from the 31st day a storage fee of €10 (ten euros) per day will be charged. right of withdrawal for customized goods is generally excluded, unless there is damage. According to the Italian Consumer Code, Article 59(c) specifies that the right of withdrawal does not apply to custom-made or clearly personalized goods, as these modifications make the product unique and not resalableGoods after 90 days of detention will be disposed of.
5.2 If custom merchandise arrives damaged, the consumer is still entitled to a replacement or refund of the product. It is important to document the damage with photos or video and contact the seller immediately to report the problem. To access the insurance, everything must be signed with reservations and sent report within 6 days.
5.3 Goods at the time of installation or assembly can no longer be disputed unless there is hidden damage.
Warranties
- All products sold by Dwelli Srls are covered by the manufacturer's conventional warranty and 24-month warranty for conformity defects, pursuant to DL 24/02. To take advantage of warranty service, the Customer must keep the invoice or receipt that they will receive via e-mail.

- The 24-month warranty in accordance with DL 24/02 applies to the product that presents a conformity defect, provided that the product itself is used correctly, in accordance with its intended use and as provided in the attached technical documentation. This warranty is reserved for the private Consumer. In case of lack of conformity, Dwelli Srls provides, without cost to the Customer, the restoration of conformity of the product by repair / replacement, until the termination of the contract. If, following intervention by an Authorized Service Center, the defect should not be a lack of conformity pursuant to DL 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transportation costs if incurred by Dwelli Srls
- Replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided for by the manufacturer. The timing of replacement or possible repair of the product depends solely on the manufacturer's policies.
- In the event that, for any reason, is unable to return to its customer a product under warranty (restored or replaced), Dwelli Srls may proceed at its own discretion to refund the full amount paid or replace it with a product of equal or superior characteristics.
- No damages can be claimed from Dwelli Srls for any delays in making repairs or replacements or cancellation of the requested item.
- In cases where the application of guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals,, etc...)
- Once the product is installed, the 14-day warranty is void unless there is hidden damage due to the manufacturer.
The cost of installation or disassembly of the product that has hidden damage is the responsibility of the customer and Dwelli Srls has no liability.
Privacy
The personal data requested when placing the order are collected and processed in order to meet the expressed requirements of the Customer and will not under any circumstances and for any reason be transferred to third parties. Dwelli Srls guarantees its customers compliance with the regulations on the processing of personal data, governed by the Privacy Code under DL 196 of 30.06.03.
The owner of the data processing is the company Dwelli srsl.
Complaints
Any complaints should be addressed to Dwelli Srls, Vico I Bari n.1, - 70014 Conversano (Ba) Italy by filling out the form.
Applicable law
For everything herein not expressly provided for and not provided for, the parties make explicit reference to national and EU, ordinary and special regulations on buying and selling, consumer rights and e-commerce.
The sales contract between the Customer and Dwelli Srls is concluded in Italy and governed by Italian Law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Bari.
